The following terms and conditions govern the Fascination Factory Membership and the benefits available there under (the "Fascination Factory Membership" or “Membership Agreement”). ALL PERSONS SUBSCRIBING TO THE Fascination Factory Membership ARE URGED TO READ THE MEMBERSHIP TERMS & CONDITIONS CAREFULLY AND IF YOU HAVE ANY QUESTIONS, CONTACT Fascination Factory AT (248) 480-9800 OR EMAIL AT info@fascinationfactory.com prior to signing. This Membership Agreement with terms & conditions is made between Fascination Factory, LLC and the person registering for membership ("you" or the "Member").

This Membership Agreement holds true for the Fascination Factory, LLC location at 2295 Lincoln St., Suite 150, Birmingham, Michigan 48009. This Membership Agreement is also valid for products, services, party program, events, admission, merchandise, information and services offered through the Fascination Factory website and social media sites.

• Description of Fascination Factory Membership. Membership information will be updated and announced on the Fascination Factory website at https://www.fascinationfactory.com/ (the “Membership Website”), including Membership fees and class prices. Fascination Factory currently offers daily drop-in visits, month-to-month and one-year memberships (each referred to as “Drop-In” or “Membership”). See Membership Website for complete details of each.
• Month-to-Month Membership. This flexible Membership requires a 90 day commitment and following this no long-term commitment. Members pay electronically in advance on the membership start date of the following months each month for that calendar month of membership. Membership is automatically renewed each month. To cancel Membership, see section on Membership Cancellation.

Membership Requirements.

I agree to abide by the Fascination Factory Participation Release and Waiver Agreement, and all posted class rules and procedures, including but not limited to:

• Fascination Factory is a shoe free zone. All guests must wear socks. Socks will be available for purchase.
• Every guest must sanitize their hands upon entering Fascination Factory, and every guest must comply with any COVID-19 or other health guidelines required by the State of Michigan or Oakland County Department of Health for the business.
• Each child must be accompanied and supervised by at least one (1) adult. Children may not be left at any Class unattended.
• For health and safety, outside food and beverages are not permitted around the toys or stations. A snack or water is permitted in the cafe. After eating, guests should sanitize or wash their hands before returning to the toys and stations.
• Communication. Fascination Factory may use your cell phone number in your membership profile to text you with updates.
• Membership Fee. All payments and fees are due in full at time of registration unless a Membership is being paid over time. A valid credit card is required to be kept on file. Fascination Factory reserves the right to modify, increase and/or update any Membership fee. All current pricing plans are available on the Membership Website. Fascination Factory reserves the right to increase the monthly dues either once per calendar year or upon the 13th month of a One-Year Membership. Fascination Factory has the right to add to the Membership dues any tax imposed by the government. Fascination Factory does not allow for freezing or prorating of Membership fees.

Credit Card Authorization.

In conjunction with the Membership application, Member hereby authorizes Fascination Factory, LLC to initiate recurring charges from the specified credit or debit card (the “Card”) set forth below for a Monthly Membership. The charge will be incurred on the same date each month that Member originally started the Membership Term (defined below)(or the following business day), for the then current balance on the Membership account (“Current Balance”).  Member hereby authorizes and consents to all charges by Fascination Factory, LLC on the Card identified herein, and affirms that the Card is a valid credit or debit card, that Member is an authorized user of the Card, and Member will not dispute these scheduled transactions as long as the transactions correspond to the terms indicated in this Membership Agreement.

Member authorizes Fascination Factory, LLC to utilize the following Card for payment of the Current Balance as set forth above and to retain and electronically store the Card information on file in Member’s account and/or a secure credit card management system:

Member understands that this authorization will remain in effect until it is cancelled in accordance with the Terms & Conditions herein, and agrees to notify Fascination Factory, LLC in writing of any changes in the Card information or termination of this authorization at least fifteen (15) days prior to the next billing date. 

Member hereby fully and forever releases Fascination Factory, LLC from any liability associated with this Credit Card Authorization, including, but not limited to, any unauthorized charges not made by Fascination Factory, LLC.

• Membership Terms/Paid Period. A Member shall be entitled to all the of the benefits available to Members of the Fascination Factory Membership commencing on the date of acceptance of the Member’s application for enrollment (the “Membership Term” or “Paid Period”). Fascination Factory reserves the right, at its sole discretion, to change the terms and conditions of this Membership Agreement at any time, with or without notice to any Member, or to cancel this Agreement. Priority registration will be provided to current Members. A parent or legal guardian is required to accompany each minor child for any Drop-In visit and at any program or class. Unaccompanied children will not be permitted into the building.
• Liability Waiver, Electronic Disclosure and Consent. As a condition of Membership, and in consideration of being allowed to enter into the Fascination Factory building and/or participate in any class, program, or any other event at Fascination Factory, a Member must agree to the Fascination Factory Participation Release and Waiver Agreement. A renewed Fascination Factory Participation Release and Waiver Agreement must be completed every 12 months in order to renew any Membership. Your submission of a Membership application shall constitute your consent to receive any and all disclosures, notices and other communications including any notice that may be legally required to be provided to you regarding this Agreement, in electronic form.

Membership Cancellation.

• Cancellation of Monthly Membership Term: Requests to cancel Monthly Membership must be submitted at least 7 days before the customers billing cycle. If received timely, your Membership will be cancelled, and your credit card will not be charged for the next month’s enrollment. To cancel this Membership Agreement, you must provide timely written notice, which states that you are cancelling this agreement, or words of similar effect. You may provide this notice by way of an e-mail sent to info@fascinationfactory.com, or you may mail or hand-deliver a signed and dated notice. Paper notices shall be sent to Fascination Factory at 2295 Lincoln St., Suite 150, Birmingham, Michigan 48009. Faxes and phone calls are NOT an acceptable means of notification. The Member must pay in full any outstanding monies due. The Member may continue to use the facility during the Paid Period and the membership ends at the conclusion of the Paid Period. 
• Late Cancellation and EFT Billing Errors: No refund of monthly dues will be paid if a Member cancels after the deadline set forth above for your Membership Term. It is the Member’s responsibility to observe proper cancellation procedures. Termination of Membership will be effective at the conclusion of the Paid Period. The Member may continue to use the facility during the Paid Period. Should a billing error occur, Fascination Factory will refund the charge with WRITTEN proof of timely cancellation, i.e. certified mail receipt and copy of cancellation, or a Fascination Factory generated e-mail confirmation of cancellation. It is the Member’s responsibility to retain records until his/her bank statement has confirmed the cancellation. 

Cancellation by Fascination Factory:

• Fascination Factory reserves the right to cancel this Membership Agreement and terminate any membership rights associated therewith for any violation by the Member of the provisions set forth within this Agreement, or as promulgated in the building or on its website, or of which Member has been verbally notified, including but not limited to: (a) failure to make payments of monies when due, (b) consistent failure to observe Rules and Regulations or abide by requirements in the Participation Release and Waiver Agreement, (c) behavior that is contrary to the best interests of other Members or guests. 
• Member Death or Disability: If the Member is unable to use the facilities because of death or disability, the Member or Member’s representative may cancel this Membership Agreement. Reasonable verification in writing must be provided. No further payments are required, and upon request a prorated portion of any pre-paid amount will be refunded to the Member or Member’s representative. 
• Member Relocation: If the Member relocates more than twenty-five (25) miles from the Fascination Factory location, and the Member is able to provide reasonable proof to validate relocation (letter of employment, lease, military orders, driver’s license, etc.), the Member may cancel this Membership Agreement with 15-Days Written Notice. 
• Fascination Factory Relocation or Closure: Should this location close and not offer an alternative location substantially similar and within ten (10) miles of its current location, the Member’s Membership may be cancelled by the Member. Member shall be relieved of the obligation of making payments for services other than those received prior to the relocation or closure. 
• Cancellations Require Written Verification: Cancellation requests will only be honored if submitted in writing. It is the Member’s responsibility to ensure they have obtained and retained authoritative written proof or confirmation of cancellation. If the member is mailing the cancellation it is recommended that the Member send the cancellation notice by registered or certified mail, return receipt requested. If cancelling by e-mail the Member must ensure they have received an e-mail confirmation of cancellation from Fascination Factory. Note that memberships cannot be cancelled by phone or verbal conversation. 
• Maintain Accurate information. It is your responsibility to maintain accurate contact information in your online member profile and contact Fascination Factory immediately if your electronic or US postal mail address changes. 
• Disclaimer of Warranties. All products, services, play, party program, events, admission, advice, merchandise and information available to Members are provided on an "as is", "as available" basis without warranties of any kind, either express or implied, including but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose. Without limiting the above, no warranty or guaranty is given regarding the completeness, accuracy, reliability or quality of any information, content, data, products, services, play, party program, events, admission, advice, merchandise available to, or purchased by Members through the Fascination Factory website or otherwise through Membership in the Fascination Factory. 
• General Release. Each Member, for himself/herself, and on behalf of any person who uses the benefits available through the Fascination Factory Membership, hereby forever releases, acquits and discharges Fascination Factory, including employees and representatives of Fascination Factory, from any and all liabilities, claims, demands, actions and causes of action that such Member or such Member's legal representatives may have by reason of any monetary damage or personal injury sustained as a result of or during the use of any and all benefits available through the Fascination Factory Membership. The sole recourse available to a Member, membership beneficiary or their legal representatives shall be the cancellation of the Membership and/or refund of any pre-paid amount, not to exceed $1,000.00.
• Attorney Fees/Interest. If a Current Balance is not paid on the 1st of the month, and no payment is received within 10 days of that date, a 1.5% monthly interest charge plus a re-billing fee of $10.00 will be charged to you the following month. If the account is sent to our attorneys or a collection agency, you agree to be responsible for all attorney fees and expenses for collection of any balances due.
• Acknowledgment and Agreement. By registering into a Fascination Factory Membership program, I indicate my acceptance and delivery of this Membership Agreement, the Terms and Conditions. I acknowledge that I have been given an opportunity to prevent or correct any error in connection with this Membership Agreement form. If I have submitted this Membership form in error, I will immediately notify Fascination Factory of the error, revoke my signature as instructed, and refrain from participating in any class, program, or Membership to which this Agreement applies.

By purchasing a membership, the Member warrants that he/she has access and has read, understands, and agrees to all Terms and Conditions of this Fascination Factory, LLC Membership Agreement as set forth above.
